We sent a letter this week to the Senate Banking Committee, in response to their draft of crypto market structure legislation.
On the critical question of which tokens should be regulated as securities, the Senate's draft takes a very different approach from the CLARITY Act that was already passed in the House.
We think the Senate's approach—"ancillary assets"—is better for crypto.
While both bills are an improvement on the Howey-based regime—which is notoriously difficult to apply and creates toxic perverse incentives for issuers—the Senate draft is significantly simpler, and avoids forcing decentralized tokens and protocols to fit themselves into an inflexible legislative framework.
Instead, it protects against abuse with a simple exclusion—assets that come with legal rights to specified financial interests do not qualify as ancillary assets.
As we explain in the letter, we think this is the cleanest test that protects decentralized crypto assets while preventing traditional securities issuers from improperly taking advantage of this framework.

🚨NEW: SDNY Acting U.S. Attorney (and former @SECGov Chair) Jay Clayton issued a statement following Roman Storm’s conviction, praising the prosecution team after securing a guilty verdict for operating an unlicensed money transmitting business.
“The speed, efficiency, and functionality of stablecoins and other digital assets offer great promise, but that promise cannot be an excuse for criminality,” Clayton said, adding that criminals committing age-old crimes like money laundering undermine the many innovators who operate lawfully.

Shout out to @frankcorva for all the fantastic coverage he’s done for @BitcoinMagazine over the last few weeks. This guy wears about a million hats as White House/political correspondent, and still managed to show up nearly every day to deliver colorful updates.
As Frank mentioned, @davidzmorris and @theragetech also provided excellent coverage, not just of the day-to-day courtroom happenings but of some of the thornier nuances this case was full of. The Tornado Cash trial has concluded.
Roman Storm has been found guilty of the conspiracy to operate an unlicensed MTB charge.
Here are my thoughts on the outcome, the government’s (rejected) motion to remand Storm, and what comes next.

🚨NEW: Just caught @rstormsf outside the courtroom. I asked how he was feeling. In a quiet voice, but with a noticeable smile, he told me:
“It’s a big win. The ‘1960’ charge is bullshit and we’re going to fight it all the way. You know how President Trump said ‘fight, fight, fight’? We’ll do that too.”
He expressed relief at not being remanded to jail and mentioned his 5-year-old daughter as one of the reasons he plans to keep fighting the one charge he was convicted on.
He said he’s heading back to Seattle tomorrow.

But to clarify: @rstormsf has been found guilty on one charge: conspiracy to operate an unlicensed money transmitting business (aka “the 1960 charge”), which, according to Storm’s lawyer Keri Axel, carries a maximum sentence of five years. The jury was hung on the other two counts: money laundering and sanctions violations.
Judge Failla denied the government’s motion to remand him to jail, stating:
“There is a lot of fighting left in this case before sentencing, and I think Mr. Storm will stay to fight it.”
As the government team exited the courtroom, I asked AUSA Rehn for comment. He seemed caught off guard (may not have realized I was press), stammered, and said: “No comment right now, but we will… yeah…” before walking out the door.
Storm remained in the courtroom, conferring with his legal team. His emotions are hard to read as he’s remained pretty stoic throughout this whole trial. I’ll try to get a comment from him as well.

🚨UPDATE in the @rstormsf trial: The jury says it’s deadlocked on some of the charges, and Judge Failla has issued an Allen charge — essentially urging them to try again to reach a verdict.
We’ll likely hear the outcome of their renewed deliberations soon.

Some low-key jury drama in the @rstormsf trial today: one juror showed up late, another asked to take tomorrow off to get a pedicure before her mum’s 90th birthday party. Judge Failla put her foot down (so to speak) and instructed the jury to return tomorrow morning from 8:30 to 12:30 if no verdict comes today.
A stark reminder that these are just everyday people, juggling real-life commitments — birthday parties, pedicures, doctor’s appointments — who will return to their normal lives after deciding whether someone else gets to return to his at all.
For now, a big NYC iced coffee near the courthouse to pass the time…🕰️
