The Fourteenth Amendment of our Constitution, which Trump is clearly against, states that Census representation must be based on the “whole number of persons in each State, excluding Indians not taxed.” It does not exclude noncitizens or undocumented individuals. In 2019, the Trump administration tried to add a citizenship question to the 2020 census; the Supreme Court allowed such questions in general but blocked its addition at that time due to insufficient justification. In 2020, Trump issued a memorandum directing that “illegal aliens” be excluded from apportionment data. Courts ruled this exceeded presidential authority, concluding that the President could not unilaterally change what “persons” meant in the Constitution.
