In 2019, the Trump administration tried to add a citizenship question to the 2020 census; the Supreme Court allowed such questions in general but blocked its addition at that time due to insufficient justification. In 2020, Trump issued a memorandum directing that “illegal aliens” be excluded from apportionment data. Courts ruled this exceeded presidential authority, concluding that the President could not unilaterally change what “persons” meant in the Constitution.
